OFFICIAL RULES FOR ALL BENJAMIN MEDIA, INC SPONSORED CONTEST

NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

ELIGIBILITY: All Benjamin Media, Inc Give-a-ways are open to legal residents of the 50 United States, including the District of Columbia, age 18 or older at the time of entry. Void in Puerto Rico, outside the U.S., and wherever else prohibited by law. Employees of Benjamin Media, Inc. (the “Sponsor”) and its respective subsidiaries, affiliates, and the immediate family members of, and/or those living in the same household of each, are not eligible to enter. All contest, give-a-ways, promotions and sweepstakes and shall hereafter be subject to all applicable federal, state and local laws and regulations. By entering, each entrant (the “Entrant”) acknowledges acceptance of and compliance with these official rules (the “Official Rules”); in addition, each Entrant agrees to accept the decisions of the Sponsor as final and binding as it relates to this Sweepstakes.

SWEEPSTAKES ENTRY PERIOD: The Sweepstakes begins at 12:00 AM Eastern Time (“ET”) and end at 11:59 PM ET on the date stated on the give-a-ways webpage. Sponsor’s computer is the official timekeeping device for this Sweepstakes.

HOW TO ENTER: During the Sweepstakes Period, directions for each contest or promotion can be found on the brands website during the promotional period.

Note: By entering the Sweepstakes via the online entry method, Entrants acknowledge that the Sponsor may contact them by mail, email and/or phone and consent to such contact. In email communications, Entrant will have the opportunity to opt-out to avoid receiving further email communications. To enter the Sweepstakes without providing consent to future email communications from the Sponsor, please use the mail-in entry method described below.

Mail-in Entry: Mail in entries are not accepted in any give-a-ways or sweepstakes.

Note: By entering the Sweepstakes via the mail-in entry method, the Entrant will not receive future email communications from the Sponsor with the exception of email communications relating directly to the administration of this Sweepstakes (e.g., winner’s notice) unless the Entrant has consented through other means to receiving such communications or has an established business relationship with the Sponsor, which permits such communications.

Entries must be received (whether online or mail-in entries) by 11:59 PM ET on on the closing day of said contest. Sponsor is not responsible for lost, late, illegible, corrupted, or misdirected entries.  All entries become the property of the Sponsor and will not be acknowledged or returned.

PRIZES/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS: Prizes: Prizes details are listed on the individual sweepstakes pages. Odds of winning depend on the number of eligible entries received.

RANDOM DRAWING & WINNER NOTIFICATION: The potential winners will be selected in a random drawing by the Sponsor taking place within 7-days from among all eligible online entries received within the corresponding contest period. The Sponsor’s decision is final.

The potential winners will be notified by the Sponsor via email and will be required to claim the prize by confirming his/her/their mailing address within 48 hours via return email. Upon confirmation of an eligible mailing address, prize will be sent to the address provided on the entry form or new address provided via email within approximately two (2) to four (4) weeks after the promotion has ended.

If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner’s parent or legal guardian who will be required to execute and return any required declaration and release on minor’s behalf.

If a selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and and an alternate winner will not be selected unless decided upon by the Sponsor.

PRIZE CONDITIONS: Taxes on prizes are the sole responsibility of the winners. Prizes are not redeemable for cash. Prizes are non-assignable or transferable. No substitution is permitted except in the Sponsor’s sole discretion, in which case a prize of equal or greater value will be awarded. No cash in lieu of prize and no exchange or substitution of prize, except at the sole discretion of the Sponsor. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility. In no event shall more prizes be awarded than the number stated in the “Prize” section above. By accepting a prize, you agree that Benjamin Media, Inc. may use your entry, name, and hometown online and in print, or in any other media, in connection with this Sweepstakes without payment or compensation to you, except where prohibited by law.

GENERAL: By entering, each Entrant agrees to hold harmless and indemnify Benjamin Media, Inc. and its subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers, and directors against any and all liability, damages or causes of action (however named or described) due to any injuries, theft, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from (a) acceptance, receipt, possession, misuse or use of any prize; (b) participation in any Sweepstakes-related activity or participation in this Sweepstakes; (c) any malfunction of the entry website; (d) any error in the collection or retention of entry information; or (e) any typographical or other error in the printing, offering or announcement of any prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participating in this Sweepstakes or use or redemption of any prize. All merchandise prizes are awarded “as is” with no at-law or implied warranties whatsoever. By participating in this promotion, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor.

Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Sweepstakes, or by any technical or human error which may occur in the processing and/or transmissions in the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to, or resulting from, participating in or downloading of materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, without individual notice, and to select a winner from all entries received up to the time of termination. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted to the full extent of the law.

DISPUTES: Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Ohio. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Ohio without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Ohio. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.

THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.

PRIVACY: By entering and providing the required entry information, Entrants acknowledge that the Sponsor may contact them by mail, email and/or phone and consent to such contact.
